The following terms and conditions listed below will apply between you and Girlyheaven for the sale and purchase of the items contained in your basket. The terms do not affect your statutory rights.
Validity.
The ordering of a product or products from Girlyheaven warrants that you accept these terms and conditions. It is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes. The terms and conditions are subject to change at any time, without prior notice.
Copyright.
All rights, including copyright, in the content of these Girlyheaven web pages are owned or controlled for these purposes by J THOMPSON t/a Girlyheaven. In accessing pages on this website, you are agreeing that the downloading of content from this website will be for your own individual and non-commercial use. You may not download, store (in any medium), copy, broadcast, transmit, show or play in public, adapt or change in any way the content of these web pages for any other purpose whatsoever without the prior written permission of the copyright owners.
Ordering Of Products.
Orders submitted through this website are subject to acceptance and product availability. The prices shown for products are correct at the time the information was entered, however, we reserve the right to change prices without prior notice.
Goods Availability.
Though we carry considerable stock of merchandise, subject to availability we seek to despatch most orders within 4 days by Royal Mail for delivery. As some of our items have to be ordered from overseas please allow up to 28 days. If your order is urgent it is adviable to email joanne@girlyheaven.com or telephone 01484 689018 to check stock before ordering.
Undertakings and Warranties.
You confirm that the information you enter during the ordering process is complete and accurate.
Acknowledgement of Order.
Once your order has been completed and submited through our secure server, an email will be sent to the email address you have supplied to confirm your order has been received. It will state what you have ordered, the total cost (including VAT and P&P) and invoice number details. If for any reason your order is incomplete or contains a query we will contact you as soon as possible by email or telephone to explain and rectify the query.
Shipping and Handling.
All products are shipped discreetly in a plain mailing bag or box, with no indication as to the contents, or reference to our company.
Royal Mail terms and conditions do require that we include our return address in case of non delivery, this is shown as: J Thompson, 62 North Road, Kirkburton, Huddersfield, HD8 0RW. No other wording is shown to ensure your complete discretion and confidentiality.
Standard shipping is dependant on weight of item (free for orders over £40 regardless of weight) sent by Royal Mail. We constantly monitor delivery times which average between 2 to 5 days according to Royal Mail guidelines.
Next Day Delivery Option.
We also offer an optional upgrade to Next Day Delivery price depandant on weight of item. Orders received by us weekdays BEFORE NOON will arrive the next working day(subject to items being in stock). We advise you phone 01484 689 018 to check stock availability first. Next Day Delivery Orders received after the noon deadline will take an additional day.
The next day delivery option is subject to stock availability, so we would suggest phoning us first on 01484 689 018 to avoid disappointment.
All delivery addresses will be copied as per the customer input. If the carrier or post cannot deliver because of incorrect address then we reserve the right to charge an additional supplement. Whilst we try to deliver all goods ordered in accordance with our pledge, we take no responsibility for any consequence of late delivery however caused.
Goods Shipped Outside The UK.
Girlyheaven UK will ship to selected countries outside the UK, however, additional postage or air freight charges will apply. Also, certain countries have laws and regulations on the type of goods allowed, it is the customers responsibility to check that the goods ordered are allowed to be shipped to the country you choose your order to go to.
Girlyheaven will not be held responsible for loss on any goods that are seized by customs, please CHECK THE CURRENT LEGISLATION IN YOUR COUNTRY ON WHAT GOODS CAN BE PURCHASED. We are happy to advise where possible on any queries you may have.
Overseas Orders.
If you choose to have goods sent to any destination outside the UK, you are further confirming that you have checked the laws regarding the country of destination the goods are going to and that these goods are legally permitted in that country.
Please see our postal rates for Postage and Packing charges for overseas orders. Payment for overseas orders may be made by Bankers Draft payable to Girlyheaven in UK Sterling or by American Express, Visa, Mastercard, Delta or Switch (issue number required) Cards. We also accept Euros, please use currency converter on the home page or email for current rates. We do not accept foreign cheques or foreign currency.
Pricing.
All prices shown on this web site include VAT at the current rate, on products where VAT is applicable, prices exclude postage, packing and administration charges unless stated otherwise. P&P charges will be shown at checkout. Prices are subject to change without prior notice. Prices quoted relate to this web site only.
Prices shown are in UK Pounds and will be billed in UK Pounds Sterling. If your credit card company operate in a different currency, they will convert payment into pounds sterling to your local currency at the prevailing conversion rate at the time of the transaction. The purchaser is liable for any local, state or foreign country taxes, if you are ordering from outside the UK, you should check first regarding any taxes that you may be required to pay on receipt of the goods you order.
Payments.
All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. All goods must be delivered to the card holders address unless otherwise agreed with a member of Girlyheaven staff.
Returning Goods.
LINGERIE
Items may be returned for a refund (less postage) within 7 days of receipt. However you MUST advise us by email or phone that you are returning the item within 2 days of receipt.. You MUST obtain a returns number. No Returns Number Strictly No Refund. Excuses such as you cannot get through on the phone will not be accepted - send an email with a reader receipt that way you will know we have received it and the returns number will be emailed to you. The item must be unworn with all tags in place and in original packaging which must be complete as the item has to be re-sold. Items returned which are not faulty and are not being exchanged for an alternative size will incure a 15% handling fee, this will be deducted from the refund. If the item is returned outside the 7 day period or in an unsaleable condition, it will be returned to the customer and charged at cost. No refund will be given. This includes items smelling strongly of cigarette smoke and worn items which we scan to make sure item has not been worn. If these instructions are not adhered to the item will be returned to you and further postage charged. If the accessories packs are opened the item will not be accepted back.
SEX TOYS & LOTION POTIONS AND PAMPERING ITEMS
Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from us. If an item is unsuitable when you receive it, provided it is returned in accordance with distance selling rights as detailed below in its original packaging and hygiene stickers are unbroken and not tampered with, we will be happy to refund the item. For health, safety and hygiene reasons, love aids, creams, sprays, latex and underwear, once opened, used or worn these items cannot be exchanged, refunded or credited unless faulty. Whilst we will deal with returned items as quickly as possible, please allow up to a maximum of 28 days for returned products. When returning any product please ensure you obtain a certificate of posting, this may be required by us, in the event of non receipt of your returned items. Product Descriptions.
We take great care in describing products as accurately as possible, we reserve the right to alter, withdraw or amend any description without prior notice, due mainly to manufacturers changes and improvements. It is sometimes necessary to send a substitute item or improved version of a product, if this is not acceptable to you, please notify us at the time of placing your order. Where dimensions and sizes are given, these are approximate. Colours and materials may differ slightly to those shown due to colour variations through electronic media and connection quality. If in doubt, please contact us before you order for clarification purposes. Batteries are not supplied with products unless stated. Batteries can be ordered at the time you place your order, see checkout page for cost.
Liability Limitation.
Subject to our obligations under the Consumer Protection (Distance Selling Regulations) Act or any relevant consumer protection legislation to give you a refund, if you cancel your contract or if we do not perform the contract within 28 days or any other agreed time, our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.
Data Protection.
We are required like all bona fide businesses, to inform you that by submitting your order to us, means we will hold your details on our database for marketing purposes and so that we can process your order. By submitting your order to us you are giving your consent for us to do this. You have our assurance that your details will not be sold, rented or hired to any third parties. The information we hold will be held securely in accordance with our internal security policy and the law.
Distance Selling Rights.
Distance Selling Rights Cancellation rights apply to orders placed on this site. Notice that you wish to cancel your order should be given by durable medium at any time up to 7 working days from the day after delivery. You are advised that due to the nature of the goods that we sell, you are unable to cancel items that have been opened. If you wish to cancel any item, you should return the goods by 1st or 2nd class Royal Mail post, and a certificate of posting must be obtained. The customer is responsible for the cost of returning the goods in this instance. Returned goods should be addressed to Girlyheaven, Cartwrights, Little Cake, hade Edge, Holmfirth, HD9 1RX. Your statutory rights remain unaffected.
Health and Safety.
Always follow manufacturers instructions on products received. If you have any medical condition, are taking medication, are pregnant or have any form of disability and you are in any doubt about a particular product, you should consult your GP or a qualified medical practitioner for their opinion before using any product. Wash products after use in warm soapy water, ensuring that the battery compartment is kept dry at all times. Never share vibrators with others. Condoms should never be used more than once.
Invalidity of Terms and Conditions.
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
Governing Law and Jurisdiction.
The contract between you and Gilryheaven shall be governed by English Law and you and Girlyheaven submit to the exclusive jurisdiction of the English courts.
